An uncontested divorce works when both spouses agree on every issue — who gets what property, how debts are split, and, if there are minor children, custody and support. If you and your spouse are on the same page, there's no reason to pay for a courtroom fight neither of you wants.

What the flat $799 fee covers

• Reviewing your situation and confirming an uncontested divorce fits (Georgia residency requirements, grounds, and whether every issue is actually agreed)
• Drafting the settlement agreement reflecting the terms you and your spouse have already worked out
• Preparing and filing the divorce petition and required paperwork with the court
• Handling service on your spouse (or preparing an acknowledgment of service if your spouse will sign one)
• Seeing the case through to a final decree

Georgia's basic requirements

To file for divorce in Georgia, either you or your spouse must have lived in the state for at least six months before filing (O.C.G.A. § 19-5-2). Most uncontested divorces are filed on the "no-fault" ground that the marriage is irretrievably broken (O.C.G.A. § 19-5-3(13)). Georgia law does not allow a judge to grant a divorce on that ground until at least 30 days have passed since your spouse was served — so even a fully agreed, uncontested case has a built-in minimum timeline before it can be finalized. Exactly how long it takes beyond that minimum depends on the county court's schedule.

When this isn't the right fit
